SNICKERS® SCHOOLS SOCCER CLINICS

TERMS AND CONDITIONS

 

Thank you for expressing an interest in participating in SNICKERS® SCHOOLS SOCCER CLINICS (“Clinics”).  Your school’s participation in the Clinics is subject to the following terms and conditions.  Effem Foods Pty Ltd ABN 48 008 454 313 (trading as Mars Confectionery of Australia) (“Edusport”) arranges the Clinics, and will not accept your booking for participation in the Clinics if you do not agree with the terms and conditions outlined below.  In these Terms and Conditions, a reference to “you” and “I” means the school identified in the booking application form which is emailed to Edusport and “your” has a corresponding meaning.

 

By clicking on the “ACCEPT” button below you agree to be bound by the terms and conditions outlined below. If you do not agree to be bound by these terms and conditions please click on the “I DO NOT ACCEPT” button below and you will be returned to the Edusport Homepage.

 

1.                  BOOKING

1.1              You acknowledge that your booking of a Clinic using this website is unconfirmed and of no effect unless and until Edusport sends to you an email verifying your booking details and advising you of your booking key number.

2.                  PARENTAL CONSENT

2.1              You must ensure that a parental consent form is:

(1)               completed and signed by a parent or guardian of each child participating in the Clinic; and

(2)               given to the Coach prior to the commencement of the Clinic.

2.2              The parental consent form can be downloaded by clicking on this link Parental Consent Form.

2.3              Children who have not provided a signed parental consent form will not be allowed to participate in the Clinic.

3.                  RESPONSIBILITIES OF TEACHERS

3.1              At least one of your teachers must be present for the duration of the Clinic.  Coaches are prohibited from beginning or continuing a Clinic unless a teacher is present.

3.2              Prior to the commencement of the Clinic, the teacher in attendance must:

(1)               advise the Coach of any pre-existing medical conditions of any children participating in the Clinic; and

(2)               advise the children participating in the Clinic that SNICKERS® contains nuts.

3.3              At the completion of each Clinic feedback forms will be provided to the teacher present.  We ask that these forms be completed and returned to:

4.                  COACHES

Coaches are engaged, and assigned for each Clinic, solely by Edusport.  A profile of each Coach can be viewed on the Soccer Coaches page.

5.                  CANCELLATION OF CLINIC

5.1              Edusport reserves the right to cancel a Clinic by notice to you:

(1)               if, in the reasonable opinion of the Coach, the climatic conditions are not conducive to running a safe Clinic;

(2)               if a Coach is unable to attend the Clinic and a replacement has not been able to be made; or

(3)               if any other circumstance arises which, in the reasonable opinion of Edusport, impedes or prevents Edusport from conducting a Clinic.

5.2              You can only cancel a Clinic by providing at least 7 days prior written notice to Edusport.

5.3              Edusport or the Coach designated to conduct a Clinic will not commence a Clinic or, if the Clinic has commenced, will cease conducting the Clinic if:

(1)               in the reasonable opinion of the Coach, climatic conditions are not conducive to running a safe clinic; or

(2)               there is not at least one of your teachers present at the Clinic.

5.4         The soccer coaches have digital cameras at the clinics and may take photos of the class to put up on the Edusport website located at www.edusport.com.au. If you do not wish your child's photo on the Edusport website, then we encourage them not to participate.

 

6.                  LIMITATION OF LIABLITY

6.1              To the fullest extent permitted by law, Edusport excludes all liability to you which may otherwise arise from or in connection with the conduct of a Clinic and/or the participation of your students in the Clinic.

6.2              You acknowledge that the Clinic will be conducted at your address, and warrant to Edusport that as the occupier of that address you will at all relevant times have in place public liability insurance coverage for an amount per claim of not less than $5,000,000.

7.                  PARTICIPATION IN FURTHER CLINICS

7.1              Bookings for additional Clinics can be made at www.edusport.com.au.  Clinics cannot be booked directly through Coaches.

8.                  GOVERNING LAW

8.1              The law of Victoria governs these terms and conditions.

8.2              The parties submit to the non-exclusive jurisdiction of the courts of Victoria and the Federal Court of Australia.
